RAFKARNA / CUSTOMER INFORMATION

Terms and conditions

Terms for the sale of goods and provision of services

1 Introductory provisions

1.1. Operator

The online shop at rafkarna.com (the “online shop”) is operated by PRO sport media s.r.o., with its registered office at Baťkovo náměstí 552/2, 500 02 Hradec Králové, Company ID: 24061239, entered in the Commercial Register maintained by the Regional Court in Hradec Králové, Section C, File 55813 (the “seller” or “operator”). Contact email: info@rafkarna.cz, telephone: +420 602 261 528.

1.2. Buyer

1.2.1. A buyer is any visitor to the online shop, whether acting as a consumer or as a business (the “buyer”).

1.2.2. A consumer is a natural person who, when concluding and performing the contract, is not acting in the course of a trade or other business activity (the “consumer”).

1.2.3. A business buyer is a buyer who is not a consumer. This also includes anyone concluding contracts related to their own trade, manufacturing or similar activity, exercising an independent profession, or acting in the name or on behalf of a business (the “business buyer”).

1.3. Terms and conditions

1.3.1. These general terms and conditions (the “terms”) govern the parties' mutual rights and obligations arising in connection with or under a sales contract concluded between the seller and the buyer through the online shop (the “sales contract”).

1.3.2. The terms form an integral part of the sales contract. Unless the sales contract or its annexes expressly provide otherwise, or a provision of these terms is excluded or modified by the sales contract or another express agreement between the seller and buyer, these terms govern the parties' relationship in all other respects.

1.3.3. Relationships between the seller and buyer not expressly governed by these terms are subject to the relevant provisions of Act No. 89/2012 Coll., the Civil Code. Relationships between the seller and consumers are also subject to Act No. 634/1992 Coll., on Consumer Protection, as amended.

2 Concluding the sales contract, delivery and payment

2.1. Goods offered

Goods displayed in the online shop are presented for information only. Their presentation is not an offer to supply goods within the meaning of Section 1732(2) of the Civil Code, and the operator is not obliged to conclude a sales contract for the displayed goods.

2.2. Order

2.2.1. The buyer may order using the form in the online shop. The buyer first selects the goods, then the quantity, delivery method (Article 2.4.1) and payment method (Article 2.5.1). Confirming the order constitutes a binding offer to conclude a sales contract between the buyer and operator.

2.2.2. By submitting an order, the buyer confirms that they have read and fully agree to these terms.

2.3. Conclusion of the sales contract

2.3.1. The operator undertakes to accept the buyer's offer to conclude a sales contract (the order) if it does not conflict with these terms and the operator has no specific reason to believe that the buyer will breach the contract. The operator confirms acceptance by a message to the buyer's email address.

2.3.2. The contractual relationship arises when the operator's acceptance of the order reaches the email address provided by the buyer in the order.

2.3.3. The buyer bears their own costs of using distance communication to conclude the sales contract, such as internet connection or telephone charges.

2.4. Delivery method

2.4.1. Within the Czech Republic, we offer One Courier delivery to your address or One delivery to a pickup point or parcel locker selected on the map at checkout. Delivery costs 100 CZK including VAT per whole order, for all products in the shop. Collection at Baťkovo náměstí 552, 500 02 Hradec Králové is free.

2.4.2. The operator undertakes to notify the buyer of dispatch at the email address provided in the order.

2.4.3. We send the parcel to the address or pickup point selected in the order. The final delivery charge is shown before the order is submitted.

2.4.4. For goods sent abroad, the operator reserves the right to add international delivery costs to the standard delivery charge.

2.5. Payment method

2.5.1. The operator offers bank transfer after completing the order, cash on delivery paid to the carrier on receipt, or cash when collecting at the operator's premises.

2.5.2. When paying by bank transfer, the buyer pays the order price to the seller's bank account before fulfilment. The payment must use the order number as its payment reference, supplied when the order is completed. Payment by bank transfer is considered made on the date the relevant amount is credited to the seller's account.

2.5.3. Cash on delivery has no surcharge and is paid to the carrier on receipt. Availability at pickup points and parcel lockers depends on the selected location. If it is not supported, checkout offers bank transfer or a different pickup point.

2.5.4. All changes, including price changes in the online shop, are reserved. The price valid at the time of ordering applies.

2.5.5. Prices of goods and services include VAT unless expressly stated otherwise.

2.6. Rights and obligations arising from the sales contract

2.6.1. The operator must supply the ordered goods at the agreed price, and the buyer must accept them and pay the purchase price.

2.6.2. If the buyer breaches the sales contract or these terms, the operator reserves the right to withdraw from the sales contract. In that case, the buyer must reimburse all costs associated with the order, particularly delivery costs if the buyer does not accept the goods.

2.6.3. The buyer must provide correct and truthful information, particularly when ordering. The seller considers the information supplied by the buyer and required to conclude the sales contract to be correct.

2.6.4. The seller is not bound towards the buyer by any code of conduct within the meaning of Section 1826(1)(e) of the Civil Code.

2.6.5. The buyer assumes the risk of a change in circumstances within the meaning of Section 1765(2) of the Civil Code.

2.6.6. All communications from the seller may be sent to the email address in the buyer's account or order.

3 Delivery of goods

3.1. Delivery period

3.1.1. The operator undertakes to dispatch goods as soon as possible. Any delivery period stated for goods is for information only and is not binding on the operator.

3.1.2. The operator is not liable for damage caused by delayed dispatch or delivery for any reason.

3.2. Delivery period and withdrawal for custom production

3.1.1. The buyer may withdraw without giving a reason from an order (contract) for custom production only until expressly approving it for production, meaning approval of the proof and quotation.

3.2.2. After approving custom production, meaning confirmation of the proof and quotation, the buyer may withdraw for a material breach by the seller only if the seller fails to deliver within 30 days after the agreed delivery date, unless the delay is demonstrably caused by the carrier. Delivery for custom products, such as wheelsets or framesets with individual paintwork, takes 6–8 weeks from final confirmation of the artwork and payment of the deposit invoice.

3.2.3. The seller may cancel the sales contract (binding order) at any time within the agreed delivery period if performance becomes impossible and no replacement performance is agreed with the buyer. In that case, the seller bears no liability for unilateral cancellation.

3.2.4. The seller may withdraw from the order (contract) for a material breach by the buyer if payment of the price is overdue by more than 15 days after the payment document's due date.

3.2.5. The parties may also agree to withdraw from an order (contract). Withdrawal must be in writing and delivered to the other party.

3.3. Transport, delivery and acceptance of goods

3.3.1. Ownership passes to the buyer upon acceptance of the goods. The risk of damage also passes at that moment.

3.3.2. Delivery includes proof of purchase stating the sale date, goods, purchase price and seller details. On request, the seller sends an electronic tax invoice.

3.3.3. On receipt from the carrier, the buyer must check the packaging and immediately report any defects to the carrier. If damage suggests unauthorised access to the parcel, the buyer is advised not to accept it and to complete a parcel damage report. By signing the delivery note, the buyer confirms that the packaging was intact.

3.3.4. The buyer must report mechanical damage, incorrect goods or similar problems not apparent on receipt immediately after discovering them. The operator is not liable for transport damage if the buyer does not promptly report it in accordance with Articles 3.2.3 and 3.2.4 of these terms.

3.3.5. If reasons attributable to the buyer require repeat delivery or a delivery method different from the order, the buyer must pay the costs of repeat delivery or the alternative delivery method.

4 Withdrawal from the sales contract

4.1. Withdrawal by the buyer

4.1.1. Where the sales contract is concluded by distance communication through the online shop, the consumer may withdraw without giving a reason and without penalty within 14 days of receiving the goods, in accordance with Section 1829 et seq. of the Civil Code. Returned goods must be complete, undamaged, demonstrably unused and bear their original tags.

4.1.2. If the consumer notifies the operator of withdrawal within the statutory 14-day period, the sales contract is cancelled from the outset. The consumer may use the withdrawal and claims form received with the goods. It should state at least the buyer's first name and surname, order number, goods and the bank account for the refund.

4.1.3. The statutory 14-day withdrawal period is met if the consumer sends notice of withdrawal to the seller within that period.

4.1.4. If the consumer withdraws within the statutory 14-day period and the returned goods are incomplete, lack original tags or are demonstrably used or damaged, the operator may claim compensation and unilaterally set off that claim against the consumer's claim for repayment of the purchase price. Only the reduced purchase price is refunded in that case.

4.1.5. The consumer acknowledges the exceptions to withdrawal under Section 1837 of the Civil Code, particularly goods customised to the buyer's wishes or personal requirements, perishable goods, goods irreversibly mixed with other goods after delivery, sealed goods removed from packaging that cannot be returned for hygiene reasons, such as underwear or swimwear, audio or video recordings or software with broken original packaging, and newspapers, periodicals or magazines.

4.1.6. A buyer exercising the right of withdrawal must send or hand back the received goods, including all parts and accessories, without undue delay and no later than 14 days after withdrawal.

4.1.7. Following valid withdrawal, the operator must refund all payments without undue delay and no later than 14 days after withdrawal, including delivery costs up to the cheapest offered delivery method. Refund is made to the consumer's bank account or in cash at the operator's premises. Another method is used only with the consumer's consent and without additional costs to them.

4.1.8. Following withdrawal, the operator need not refund payments until the goods are returned or the consumer proves they have sent them back.

4.1.9. If the buyer withdraws without entitlement and nevertheless returns goods, the goods will not be accepted or will be sent back at the consumer's expense.

4.1.10. Where a gift is supplied with the goods, the gift agreement is subject to the condition that withdrawal from the sales contract by the buyer terminates the gift agreement, and the buyer must return the gift with the goods.

4.2. Withdrawal by the operator

4.2.1. Although the operator monitors the market for the goods sold, exceptional circumstances may prevent delivery on the agreed terms. The operator therefore reserves the right to withdraw in those cases.

4.2.2. The operator may also withdraw if supplier prices or transport prices change significantly, or if goods were mistakenly offered at an incorrect price and the buyer does not accept the corresponding contract amendment, such as a higher goods price or delivery cost.

4.2.3. The buyer acknowledges that the seller may withdraw from a sales contract with a buyer who materially breached an obligation in a previous contractual relationship. For withdrawal purposes, such a material breach is conduct within the meaning of Section 2002(2) of the Civil Code.

4.2.4. If the operator withdraws, the buyer must be notified immediately at the email address in the order, and any purchase price already paid must be refunded in full.

5 Rights arising from defective performance

5.1. The parties' rights and obligations concerning defective performance are governed by applicable mandatory law, particularly Sections 1914–1925, 2099–2117 and 2161–2174 of the Civil Code and the Consumer Protection Act.

5.2. The seller is responsible for the goods being free of defects on receipt. In particular, when the buyer receives the goods:
• the goods have the agreed properties or, without an agreement, the properties described by the seller or manufacturer or reasonably expected in light of their nature and advertising; they are suitable for the purpose stated by the seller or the usual purpose of that type of goods;
• the quality or design matches the agreed sample or model, if determined by one; the goods are supplied in the appropriate quantity, dimensions or weight and meet legal requirements.

5.3. The consumer may exercise rights arising from a defect in consumer goods within the statutory period, namely 24 months from receipt. If a usage period is stated on the goods, packaging, instructions or under other law, the statutory provisions on a quality guarantee apply. If a defect appears within 6 months of receipt, the goods are presumed to have been defective on receipt.

5.4. The buyer may exercise defect-related rights at the seller's premises, in person or by post or another delivery service.

5.5. When exercising defect-related rights, the buyer must prove the conclusion of the sales contract. The operator recommends presenting proof of purchase.

5.6. The buyer must notify the seller of the defect and describe the reason for the claim.

5.7. The buyer has no defect-related rights if they knew of the defect before receipt or caused it themselves.

5.8. The seller or authorised employee decides on a consumer claim immediately or, in complex cases, within 3 working days. The time reasonably needed for expert assessment, depending on the goods or service, is excluded. The claim, including remedying the defect, is resolved without undue delay and no later than 30 days after it is made, unless a longer period is agreed with the consumer.

5.9. If the operator does not reject the claim, a receipt is issued identifying the operator and buyer, the claimed defect, the remedy requested by the buyer, the date and place of receipt and the operator's employee's signature.

5.10. The consumer is entitled to reimbursement of reasonable costs incurred in exercising defect-related rights.

5.11. The operator must notify the buyer that the claim has been resolved and how, using the email address or other contact details provided with the claim. The notification states the deadline for collecting the goods.

5.12. If the buyer does not collect the goods by the stated deadline, the operator may charge reasonable storage costs or sell the goods on the buyer's account. The buyer must be warned in advance and given a reasonable additional period to collect them.

5.13. The operator is not liable for direct or indirect loss, injury or property damage caused by a defect in supplied goods unless it resulted from the operator's negligence, omission or intention.

6 Personal data protection

6.1. Processing personal data for orders, customer accounts and communication is governed by Regulation (EU) 2016/679 (GDPR). Marketing consent is not required to fulfil an order or comply with legal obligations.

6.2. Details of processing purposes, recipients and customer rights are available in the Privacy policy. Purchasing or signing in does not subscribe you to a newsletter.

7 Final provisions

7.1. Czech is the language of communication between the operator and buyer and the language of the sales contract. Concluded sales contracts are archived electronically by the operator and are not accessible to other persons.

7.2. If any provision of these terms is invalid or ineffective for any reason, the other parts of the terms and sales contract remain valid and effective.

7.3. The operator may amend or supplement these terms. Revised terms take effect when published. Rights and obligations arising before the effective date of a new version are unaffected.

7.4. If the sales contract contains an international element, the parties agree that Czech law governs their relationship. This does not affect consumer rights arising from mandatory law.

7.5. The seller is authorised to sell goods under a trade licence. The competent trade licensing authority supervises the licensed activity. The Office for Personal Data Protection supervises personal data protection. Within its competence, the Czech Trade Inspection Authority supervises compliance with Act No. 634/1992 Coll., on Consumer Protection, as amended.

7.6. The parties agree that courts of the Czech Republic have jurisdiction over disputes between the operator and buyer. Consumer disputes may also be resolved out of court, for example through the Czech Trade Inspection Authority. Before starting an out-of-court procedure, the operator recommends first trying to resolve the situation by email at info@rafkarna.cz.
